Terms and Conditions

These Terms and Conditions (referred to as “Terms and Conditions”) constitute a binding contract between you and UPCX-Platforms Pte. Ltd. (referred to as “UPCX”).

These Terms and Conditions (referred to as "Terms and Conditions") constitute a binding contract between you and UPCX-Platforms Pte. Ltd. (referred to as "UPCX"). This agreement contains the rules and restrictions governing the use by individuals and/or legal entities (referred to as "user" or "users") of the Digital Fan Engagement website, products, services and mobile application (referred to as "DFE" or "DFE platform").

By using DFE platform, users will be assumed to agree to the Terms and Conditions set forth. This includes the Privacy Policy and any other policies and guidelines available on the platform. Accepting the Terms and Conditions is mandatory for access to any DFE platform features. If a user does not accept the Terms and Conditions, they will not be able to use the platform.

ABOUT US

UPCX-Platforms Pte. Ltd. is a company incorporated under the laws of the Republic of Singapore, with its registered office at 18 Robinson Road, #20-02, Singapore 048547, and registered under Unique Entity Number (UEN) 201214088D.

UPCX owns Digital Fan Engagement website, mobile application, and related services. Our objective is to offer users a platform to engage with athletes competing under World Aquatics, allowing them to follow events and support athletes through a secure voting system.

Through a formal sponsorship agreement with World Aquatics, UPCX holds exclusive rights to utilize athlete data, media, and other official content for the DFE platform. All interactions and votes within the platform are managed in accordance with this agreement, ensuring compliance with relevant rules and regulations.

VOTING SYSTEM

DFE platform utilizes a blockchain-based voting system, enabling users to support their favorite athletes during specific sports events using votes called "DFE tokens" These tokens are gifted by UPCX when users create an account in the DFE mobile application, with UPCX covering the gas fees for the blockchain transactions. DFE leverages the UPCX blockchain, ensuring the voting system is secure and incorruptible. Upon registration, each user receives two DFE tokens per event, which can only be used for a single event, regardless of the number of races or categories within it.

Purpose and Usage

DFE tokens serve exclusively as encrypted votes within the platform's ecosystem. The term "token" is used solely to represent these votes, which have no monetary or market value.

  • Not a Virtual Asset: DFE tokens are not cryptocurrencies or financial instruments.
  • No Market Value: DFE tokens cannot be traded, bought, sold, or used to derive any economic benefit.
  • Voting-Only Purpose: DFE tokens are provided purely to cast votes during eligible sport events as outlined below.

Why is blockchain important to DFE Platform?

The use of blockchain technology ensures that every vote is immutably and transparently recorded, safeguarding the voting process from manipulation or tampering.

  • Anti-Tampering: Blockchain's decentralized nature ensures that once a vote is cast, it cannot be altered or deleted, protecting the legitimacy of the voting process.
  • Detecting and Blocking Bots: Ensuring that only real fans can vote helps identify the platform's genuine audience. This is critical, as exclusive discounts, coupons, and special offers will be extended only to real voters (not bots or fake users).

By securing the voting process through blockchain, DFE mobile app creates a trusted environment where fan engagement is genuine, and athletes receive meaningful support from authentic followers.

Transaction Transparency

Since UPCX pays all blockchain fees and handles transactions for users, strict KYC is not required. However, we collect some personal information to ensure transparency.

UPCX Blockchain is public and linked to the user's nickname, while UPCX maintains a separate internal registry with full names to verify that votes are cast by real users. This internal registry is not public and is not shared with any external company.

Key Voting Rules

Although strict KYC is not required, collecting essential information such as Full Name and User ID allows UPCX to track voting activity within the app. This ensures that any irregularities can be identified and addressed if necessary, preventing misuse of the voting system (e.g., multiple votes from the same account or bot voting).

Blockchain Operations

UPCX conducts transactions and covers blockchain fees on behalf of users, it allows UPCX to monitor that each vote corresponds to the correct user's identity.

User information is not uploaded to UPCX blockchain.

Key Voting Rules

  • One Vote per Athlete Gender: Users can cast one vote for a male and one for a female athlete per event. Voting for two athletes of the same gender is not allowed.
  • One-Time Vote: Votes are final upon submission and cannot be changed, re-cast, or corrected. Errors in voting will not be reversible.
  • Token Activation: Tokens reset for each new event, and users receive two new tokens. Unused tokens from previous events are not carried forward.
  • Blockchain Security: All votes are encrypted and securely stored on the UPCX blockchain, ensuring transparency and integrity.

DFE platform does not influence or alter voting outcomes. All competition information, including event schedules and results, is provided by World Aquatics and displayed within the application.

WEBSITE

DFE website provides comprehensive information about competitions, athlete profiles, and real-time results. Users can freely browse the website without the need to create an account or sign in. However, please note that DFE tokens cannot be used through the website.

To access all features related to DFE tokens, users must download DFE mobile app. The app offers full integration of DFE token functionalities, enabling users to participate in the voting system and other token-based activities.

DFE website includes a download link for the mobile app, ensuring users can easily transition to the app for a more interactive experience with all available features.

MOBILE APP

DFE mobile app offers full integration of all DFE token functionalities, providing users with a seamless way to engage with athletes and participate in token-based activities. Below are the key features of DFE mobile app:

  • Account Creation: Users can create an account to access DFE mobile app, with minimal information required. UPCX does not conduct strict KYC (Know Your Customer) checks but collects essential details to maintain a voting record.
  • Fan Engagement: DFE mobile app gives users access to athlete profiles, event schedules, and real-time updates from World Aquatics. Fans can cast votes during competitions using DFE tokens, ensuring meaningful and authentic engagement.
  • Voting System: The app integrates a blockchain-based voting system built on UPCX blockchain. Each vote is cast using DFE tokens, with biometric validation ensuring only authorized users can vote. Votes are permanently recorded on the blockchain, providing transparency and preventing tampering or alteration.
  • Account Closure: Users can request account deletion at any time using the account deletion button in the mobile app or by contacting us through customer support.

DFE mobile app provides users with a trusted and transparent environment, ensuring every vote is securely recorded and promoting authentic fan engagement. With all transactions managed on UPCX blockchain, the app ensures integrity and security throughout the voting process.

PRIVACY POLICY

DFE platform values the privacy of its users and is committed to protecting their personal data. The collection, processing, and storage of personal information in connection with the use of DFE platform, DFE website, DFE mobile app, and related services are governed by our Privacy Policy, available as a separate document.

By using DFE platform, users acknowledge and agree that DFE platform may collect and process personal data, both provided directly by users and automatically collected through platform usage. All data will be processed in accordance with the Privacy Policy, which is updated periodically to reflect changes in our data handling practices or legal requirements.

DFE platform is not responsible for the content, privacy policies, or practices of these external services. Users understand that DFE platform will not be liable for any damages or issues resulting from interactions with these third-party services, and we encourage users to review their Terms & Conditions and Privacy Policies before engaging with them.

Data Retention and Deletion

Personal data will be retained only as long as necessary to fulfill the purposes for which it was collected, as outlined in the Privacy Policy. Users can request data deletion at any time, following the procedures described in the Privacy Policy. Account deletion requests can also be made through DFE mobile app or by contacting DFE customer support.

For a detailed explanation of how DFE platform collects, uses, and protects users' personal data, users are encouraged to review the Privacy Policy available on both DFE website and DFE mobile app. This document outlines users' rights and the measures taken to ensure the security and confidentiality of their personal information.

INTELLECTUAL PROPERTY

UPCX-Platforms Pte. Ltd. is the owner and operator of the DFE platform, which includes the DFE mobile app, DFE website, and related products and services. All technology, software, data compilations, and other original content created by UPCX for the DFE platform are the exclusive property of UPCX and are protected by international intellectual property laws, including copyright, trademark, and patent regulations.

Through a sponsorship agreement with World Aquatics, UPCX is granted the right to use World Aquatics' intellectual property, including logos, photos, event images, athlete profiles, and other proprietary materials, strictly for use on the DFE platform. While UPCX manages and operates the platform, World Aquatics retains full ownership of its content, logos, and branding.

This agreement allows UPCX to incorporate World Aquatics' content intellectual property into the DFE platform for users to follow events, vote for athletes, and receive marketing offers. However, UPCX does not own any of the World Aquatics-related intellectual property used on the platform, and these materials are used under a license provided by World Aquatics.

Users are granted a limited, non-exclusive, non-transferable, and revocable access to use DFE platform for personal, non-commercial purposes. This access does not grant users any ownership rights over the content, nor does it allow users to modify, reproduce, distribute, or otherwise exploit the content without prior written consent from UPCX, World Aquatics, or the respective rights holders.

Unauthorized use or violation of these Terms may result in the suspension or termination of users' access to the platform and may expose users to legal consequences for intellectual property infringement.

Prohibited Activities

  • Copying, redistributing, or reproducing any part of DFE platform or its content for commercial purposes.
  • Reverse engineering, decompiling, or attempting to extract the source code of any software within the DFE platform.
  • Using any trademarks, logos, or intellectual property of World Aquatics without prior written permission from World Aquatics.
  • Using any trademarks, logos, or brand elements of UPCX without prior written permission from UPCX.

All trademarks, service marks, logos, and proprietary materials provided by World Aquatics and displayed on the DFE platform are the exclusive property of World Aquatics. All other content, including software and underlying technology, is the exclusive property of UPCX. Nothing in these Terms grants users any rights to use World Aquatics' or UPCX's intellectual property without prior written consent from the respective rights holders.

DFE platform reserves all rights not expressly granted in these Terms and Conditions, ensuring full protection of intellectual property across all platforms, including the DFE website and DFE mobile app.

DFE platform provides various support channels to ensure that users can get help quickly and efficiently:

Note: Misuse of support channels, including offensive or inappropriate behavior, may result in account suspension or closure.

SERVICE INTERRUPTION DUE TO FORCE MAJEURE

DFE platform strives to provide continuous and reliable service. However, certain unforeseeable events beyond our control, such as natural disasters, government actions, strikes, pandemics, or other force majeure circumstances, may result in temporary service interruptions or delays.

In such cases, DFE platform reserves the right to suspend, limit, or terminate access to its services temporarily or permanently for reasons including, but not limited to, maintenance, security updates, or operational requirements. Whenever feasible, users will be notified in advance of any planned interruptions.

DFE platform will make reasonable efforts to restore services as quickly as possible, but will not be held liable for any disruptions caused by events outside of its control. Users will be kept informed of any significant service interruptions through DFE website, mobile app, email notifications, and social media channels.

COMPLIANCE WITH LAW AND REGULATIONS

DFE platform is fully committed to operating in strict compliance with the laws and regulations of Singapore, including but not limited to the Personal Data Protection Act (PDPA) and other applicable privacy laws. In accordance with the PDPA, DFE platform ensures that all personal data collected is managed securely, transparently, and in compliance with the required legal obligations for data protection and privacy.

DFE platform upholds the highest standards of data integrity and user protection, implementing robust measures to safeguard the collection, use, disclosure, and storage of personal data. These measures are designed to prevent unauthorized access, misuse, or loss of information, as outlined in the PDPA. Users' rights under the PDPA are fully respected, ensuring that personal data is processed lawfully, transparently, and responsibly.

In the event of any legal disputes or claims arising from the use of DFE platform, the laws of Singapore shall govern these matters. Users acknowledge and agree that the courts of Singapore will have exclusive jurisdiction to resolve any disputes. By using DFE platform, users consent to this jurisdiction and agree to comply with all relevant Singaporean legal standards.

MODIFICATIONS OF TERMS AND CONDITIONS

DFE platform reserves the right to update, modify, or amend these Terms and Conditions at any time, whether for legal, regulatory, operational reasons, or to reflect changes in our services. Any modifications will become effective once posted on the DFE platform. It is the user's responsibility to periodically review the Terms and Conditions to stay informed of any updates. Continued use of the platform after any changes are published will be considered as acceptance of the revised Terms and Conditions.

The official version of these Terms and Conditions is provided in English, with translations available for convenience. In the event of any discrepancies between the English version and a translated version, the English version shall prevail.

DEFINITIONS AND INTERPRETATIONS

  • Terms and Conditions: Refers to this legally binding agreement between the user and UPCX-Platforms Pte. Ltd. that governs the use of the DFE platform, including all rules, restrictions, and guidelines.
  • UPCX-Platforms Pte. Ltd. (UPCX): The company incorporated in Singapore that owns, operates, and manages DFE platform.
  • World Aquatics: The sole and exclusive governing body for aquatic sports worldwide, including swimming, diving, water polo, artistic swimming, open water swimming, high diving, and other aquatic disciplines.
  • Sponsorship Agreement: The formal contract between UPCX and World Aquatics under which World Aquatics grants UPCX the exclusive rights to use World Aquatics' logos, images, athlete profiles, event data, and other official content on the DFE platform. This agreement allows UPCX to incorporate World Aquatics intellectual property into the DFE platform for promotional purposes, including supporting athletes and providing marketing offers to users.
  • User/Users: Refers to individuals or legal entities who access or use the DFE platform, including its website, mobile application, and services.
  • Digital Fan Engagement (DFE platform): A platform owned by UPCX that enables users to follow athletes participating in World Aquatics events and support them through a secure, blockchain-based voting system. Includes all components of the Digital Fun Engagement ecosystem, encompassing the DFE mobile application, products, services and DFE website.
  • DFE website: The official website that provides comprehensive information about competitions, athlete profiles, and real-time results. It allows browsing without requiring users to create an account or sign in.
  • DFE mobile application: The mobile app where users can create accounts, access DFE tokens, and participate in the platform's interactive features, including voting for athletes.
  • DFE tokens: Votes gifted by UPCX to users upon account creation, used within the UPCX blockchain-based voting system. These tokens are exclusively for voting purposes and are not virtual assets, cannot be traded, bought, or sold, and have no monetary value. Their sole function is to allow users to cast secure and immutable votes for their favorite athletes during specific sports events.
  • Privacy Policy: A separate document that governs the collection, processing, security, and storage of users' personal data by the DFE platform.
